Whether a tax applies depends on the transfer.

Maryland and local governments charge transfer and recordation taxes on many deeds. Some transfers may qualify for an exemption.

  • Amounts can differ between the city and the county.
  • Recording fees are set by the court and paid on top of any tax.
  • Eastern Title cannot advise you on whether a tax or exemption applies to you.

Can you add or remove a name on a deed?

Yes. Send us the property, who is on the deed now, and who is being added or removed. We coordinate the signing and record the deed. We cannot tell you whether a change is right for your situation.

Can a deed be changed after a divorce or separation?

Yes. When a divorce or separation changes who is on the property, we coordinate the new deed and record it. Have the names ready exactly as they should appear. We cannot tell you what your divorce paperwork requires.

Can you put a property into a trust or an LLC?

Yes. We coordinate the deed that moves a property into or out of a trust or an LLC. Have the exact name of the trust or company ready. We cannot tell you whether a trust or an LLC is right for you.

Can you help after an owner has died?

Yes. Tell us the property and who is named on the deed now, and we will tell you what we need to move it forward. We cannot tell you who is entitled to the property.

Where is a deed recorded for a Baltimore property?

With the Circuit Court where the property is: the Circuit Court for Baltimore City or the Circuit Court for Baltimore County. They record separately.

Do you serve both Baltimore City and Baltimore County?

Yes. We coordinate deed signing and recording for properties in both. A Baltimore mailing address is not always in the city, so send the street address and we will check.

Is Baltimore City in Baltimore County?

No. They are separate, and each has its own Circuit Court. A deed is recorded with the one where the property is.

How does the signing work?

We schedule a time with everyone who needs to sign and arrange the notary. Each signer should bring a valid photo ID.

How long does it take?

It depends on how quickly everyone signs and on the Circuit Court's recording time. We keep you updated at each step.

What does the service cost?

Our service fee is $595. Recording fees and any transfer or recordation taxes are separate.

Do I have to pay a transfer or recordation tax?

It depends on the transfer and where the property is. Some transfers may qualify for an exemption. We cannot tell you whether one applies to you.

Does a mortgage affect a deed change?

A lender may have its own rules about changes to who is on the property. If there is a mortgage, it is worth asking your lender before you sign. We cannot advise you on your loan.

Can Eastern Title give me legal advice?

No. Eastern Title provides title and settlement services and cannot advise you on your legal rights or which deed fits your situation.

What should I have ready?

The property address, who is on the deed now, who is being added or removed, and how they are related.
